By using PaceMark, you agree to these terms. Please read them carefully.

1. Acceptance of terms

By downloading, installing, or using the PaceMark application, you agree to be bound by these terms of use. If you do not accept these terms, do not use the application.

2. Description of service

PaceMark is a voice guidance application for trail running. It allows you to:

Import GPX route files
Place voice milestones on these routes
Receive voice announcements during your run

PaceMark is a complementary guidance tool and does not replace a GPS watch, a map, or your personal judgment.

3. Appropriate use

You agree to:

Use the application for its intended purpose
Not attempt to circumvent the application's security measures
Not use the application for illegal purposes
Stay vigilant during your runs and not rely solely on voice guidance

4. In-app purchases

PaceMark offers in-app purchases to access certain features. These purchases are:

Processed by Apple via the App Store
Subject to Apple's terms regarding in-app purchases
Non-refundable, except as provided by Apple's policy

For any refund request, please contact Apple Support.

5. Intellectual property

The PaceMark application, its design, code, and content are protected by copyright. You may not:

Copy, modify, or distribute the application
Reverse engineer it
Use the PaceMark brand without authorization

6. Limitation of liability

PaceMark is provided "as is". We do not guarantee:

The accuracy of GPS data or voice announcements
Uninterrupted operation of the application
Compatibility with all GPX files

Important: PaceMark is an assistance tool. You remain solely responsible for your safety during your runs. Never rely solely on an application for navigation in difficult terrain.

7. Data and privacy

Your use of PaceMark is also governed by our Privacy Policy. All your data remains stored locally on your device.

8. Application changes

We reserve the right to:

Modify the application's features
Update these terms of use
Discontinue the service with reasonable notice

9. Termination

You may stop using PaceMark at any time by uninstalling the application. We reserve the right to suspend access in case of violation of these terms.

10. Governing law

These terms are governed by French law. Any dispute shall be submitted to the competent courts of France.
